| BUCK MOUNTAIN PROPERTY OWNERS ASSOCIATION, INC. General Rules and Regulations 1. While present within a common area (including the roads), members must comply with verbal directives issued by a Director or their designee relating to behavior which has been deemed by the Director or designee to impact the immediate safety of others or to be an obvious “obnoxious or offensive activity which is a nuisance or annoyance to the neighborhood” as described in the Declaration of Covenants. [2006.01.14.1] 2. All off-road use of the roads and common areas within Buck Mountain must conform to the Off-Road Vehicle Policy as established and amended by the Board. Wilkes County Sheriff deputies are authorized to stop and investigate any off-road vehicle failing to display a permanent registration tag or an appropriate guest permit issued by the Association. Any violator not owning land within the development (or a immediate member of a family owning land in the development) shall be subject to prosecution for trespass where appropriate, and any property owner or member of his/her family in violation of the policies on off-road vehicle usage shall be subject to a disciplinary hearing under procedures as established by the declaration of covenants controlling the Association. [2002.10.11.3; 2006.01.14.1]. 3. All builders must maintain a construction dumpster on the mountain for the disposal of construction waste. Construction dumpsters may be shared between projects provided that excessive debris is not allowed to accumulate at any single construction site. 4. Property owners building their own home are not required to maintain an on-site dumpster, but construction waste must be removed on a frequent basis and the site must be properly maintained. Failure to follow these guidelines may result in the requirement of a construction dumpster. Property owners are considered to be building their own home only if the building permit was issued in the property owner’s name and the property owner has not hired a professional to oversee the project. 5. Placement of any construction debris in a POA-maintained dumpster is illegal, and will not be tolerated. Property owners will be subject to a $500 fine if construction waste from their site is placed in any POA dumpster. 6. Burying construction debris of any kind is illegal (punishable by fines up to $25,000) and environmentally unfriendly. It will NOT be tolerated on Buck Mountain. 7. Open burning of any yard debris or other materials is not permitted without a burning permit issued by the U.S. Forestry Service. All open fires must have someone physically on site near the fire until it is completely distinguished. 8. The speed limit for all vehicles throughout the community is 25 miles per hour. 9. In order to avoid dusting pedestrians and avoid unsafe conditions, all vehicles must slow down when approaching pedestrians, members riding on horseback, or ATVs. 10. The roads within the community are not generally wide enough to accept long-term parking within the road right-of-way. Parking within the road right-of way is not permitted, except for special events where it may be necessary. Overnight parking within the road right-of-way is never permitted. 11. No outdoor burning is permitted within the community without a valid burning permit issued by the North Carolina Forestry Service, unless within an enclosed device made specifically for outdoor fires. 12. Swimming and canoeing in the pond at Deer Run is hereby prohibited for reasons of safety and concerns of liability [2002-10-11.1] 13. Climbing on the rocks at Staghorn Falls or crossing the rope barriers is unsafe and is not permitted. 14. Members and their guests are required follow all posted signage relating to the use of common areas. This includes fishing limits posted at the pond, restrictions on the use of garbage dumpsters, road signage, entrance gate directives, and all similar signage. |
